A Team (en adelante, el "Responsable") es responsable del tratamiento de los datos personales recabados a través del sitio web the-ateam.ai y de la plataforma de agentes inteligentes.

II. DATOS QUE RECOPILAMOSII. DATA WE COLLECT
2.1 Datos proporcionados directamente. Nombre y apellido, dirección de correo electrónico, número de teléfono/WhatsApp, razón social y CUIT/CUIL (cuando corresponda), información de pago (procesada por terceros certificados PCI-DSS), mensajes e instrucciones que el Cliente cargue en la plataforma.
2.1 Directly provided data. First and last name, email address, phone/WhatsApp number, company name and tax ID (where applicable), payment information (processed by PCI-DSS certified third parties), messages and instructions uploaded by the Client to the platform.
2.2 Datos recopilados automáticamente. Dirección IP, tipo de navegador y sistema operativo, páginas visitadas y duración de la sesión, identificadores de cookies y tecnologías similares, logs de uso de la plataforma (acciones, errores, marcas de tiempo).
2.2 Automatically collected data. IP address, browser type and operating system, pages visited and session duration, cookie identifiers and similar technologies, platform usage logs (actions, errors, timestamps).
2.3 Datos de terceros (usuarios finales del Cliente). Cuando el Cliente carga su cartera de pagadores u otros contactos, A Team procesa dichos datos en calidad de Encargado del Tratamiento, bajo las instrucciones del Cliente (ver Sección 12 de los Términos y Condiciones).
2.3 Third-party data (Client's end users). When the Client uploads their payer portfolio or other contacts, A Team processes such data as Data Processor, under the Client's instructions (see Section 12 of the Terms and Conditions).
III. FINALIDADES DEL TRATAMIENTOIII. PURPOSES OF PROCESSING
3.1 Prestación del servicio. Crear y gestionar cuentas de usuario, ejecutar las funciones de los Agentes de IA configuradas por el Cliente, procesar pagos y emitir comprobantes.
3.1 Service provision. Creating and managing user accounts, executing AI Agent functions configured by the Client, processing payments and issuing receipts.
3.2 Comunicaciones. Enviar notificaciones transaccionales (confirmaciones, alertas, actualizaciones), responder consultas y brindar soporte técnico.
3.2 Communications. Sending transactional notifications (confirmations, alerts, updates), responding to inquiries and providing technical support.
3.3 Mejora del servicio. Analizar datos anonimizados y agregados para detectar errores, optimizar el rendimiento y desarrollar nuevas funcionalidades. A Team no utiliza datos personales individuales para entrenar modelos de IA sin consentimiento explícito.
3.3 Service improvement. Analyzing anonymized and aggregated data to detect errors, optimize performance and develop new features. A Team does not use individual personal data to train AI models without explicit consent.
3.4 Cumplimiento legal. Satisfacer las obligaciones legales aplicables (impositivas, contables, de auditoría) y responder a requerimientos de autoridades competentes.
3.4 Legal compliance. Meeting applicable legal obligations (tax, accounting, audit) and responding to requests from competent authorities.

IV. PROVEEDORES Y DESTINATARIOS TERCEROSIV. THIRD-PARTY PROVIDERS AND RECIPIENTS
A Team puede compartir datos con proveedores que actúan como subencargados del tratamiento, sujetos a acuerdos de confidencialidad y compromisos de seguridad equivalentes a los establecidos en esta Política. Entre ellos:
A Team may share data with providers acting as sub-processors, subject to confidentiality agreements and security commitments equivalent to those established in this Policy. These include:
Infraestructura cloud: Google Cloud Platform (almacenamiento, cómputo, base de datos). Comunicaciones: Meta / WhatsApp Business API (mensajería), proveedores de email transaccional. Pagos: procesadores certificados PCI-DSS (los datos de tarjeta nunca son almacenados por A Team). Analítica: herramientas de monitoreo de rendimiento con datos anonimizados.
Cloud infrastructure: Google Cloud Platform (storage, compute, database). Communications: Meta / WhatsApp Business API (messaging), transactional email providers. Payments: PCI-DSS certified processors (card data is never stored by A Team). Analytics: performance monitoring tools with anonymized data.
A Team no vende, alquila ni cede datos personales a terceros con fines comerciales propios.
A Team does not sell, rent or transfer personal data to third parties for their own commercial purposes.
V. TRANSFERENCIAS INTERNACIONALES DE DATOSV. INTERNATIONAL DATA TRANSFERS
Algunos de nuestros proveedores de infraestructura (como Google Cloud Platform) operan fuera de Argentina. Cuando esto ocurre, A Team adopta las salvaguardas adecuadas conforme al art. 12, Ley 25.326, exigiendo contractualmente a los proveedores niveles de protección equivalentes a los vigentes en Argentina.
Some of our infrastructure providers (such as Google Cloud Platform) operate outside Argentina. When this occurs, A Team adopts appropriate safeguards pursuant to art. 12, Law 25,326, contractually requiring providers to maintain protection levels equivalent to those in force in Argentina.
VI. PLAZOS DE RETENCIÓNVI. RETENTION PERIODS
Datos de cuenta y operativos: durante la vigencia del contrato y por hasta cinco (5) años adicionales para cumplimiento de obligaciones legales y fiscales.
Account and operational data: during the term of the contract and for up to five (5) additional years for compliance with legal and tax obligations.
Datos de usuarios finales del Cliente: eliminados o devueltos dentro de los treinta (30) días corridos posteriores a la finalización del contrato con el Cliente responsable.
Client end-user data: deleted or returned within thirty (30) calendar days following termination of the contract with the responsible Client.
Logs técnicos: conservados por noventa (90) días y luego anonimizados o eliminados.
Technical logs: retained for ninety (90) days and then anonymized or deleted.
Datos de marketing / comunicaciones comerciales: hasta que el titular revoque su consentimiento. Toda comunicación incluye un enlace para darse de baja.

Cifrado: datos en reposo con AES-256; datos en tránsito mediante TLS 1.2 o superior. Control de acceso: principio de mínimo privilegio; autenticación multifactor para el personal de A Team. Auditoría: registros de acceso y operaciones críticas conservados por noventa (90) días. Respuesta a incidentes: ante una brecha de seguridad que afecte sus datos, A Team notificará al Cliente y/o titular dentro de las 72 horas de tomar conocimiento, e informará a la AAIP cuando corresponda.
Encryption: data at rest with AES-256; data in transit via TLS 1.2 or higher. Access control: least-privilege principle; multi-factor authentication for A Team staff. Audit: access logs and critical operations retained for ninety (90) days. Incident response: in the event of a security breach affecting your data, A Team will notify the Client and/or data subject within 72 hours of becoming aware, and will report to the AAIP where required.
